
MR. AKASH GUPTA
Mr. Akash Gupta is an Associate Partner at Factum Legal, a practising Company Secretary and an Advocate, and has been associated with the Firm since its inception. With over 14 years of professional experience, he advises domestic and international clients on a broad spectrum of corporate, commercial, regulatory, and secretarial matters, with a strong focus on corporate structuring, cross-border transactions, and regulatory compliance.
His practice encompasses corporate and commercial advisory, including drafting and negotiation of Share Purchase Agreements (SPAs), Joint Venture Agreements (JV Agreements) and other transactional documentation. He advises clients on incorporation and restructuring of companies and LLPs, corporate governance, legal opinions, and general corporate law matters. He also has extensive experience in FEMA and RBI compliances, including advisory on External Commercial Borrowings (ECB), Overseas Direct Investment (ODI), and other cross-border transactions.
Mr. Gupta regularly advises clients on foreign exchange regulations, import and export transactions, and regulatory matters applicable to Nidhi Companies. He is also involved in conducting secretarial audits, legal due diligence, and acting as a Scrutinizer for various corporate entities, assisting companies in ensuring robust governance and compliance frameworks.
His practice also includes advising companies on corporate exit and restructuring mechanisms under the Companies Act, 2013 and Insolvency and Bankruptcy Code, 2016, including strike-off and winding-up proceedings.
